1. About these terms
These terms are an agreement between you (“you”, the parent or guardian) and Nightly Story, operated by Chris Clark, based in Bolton, United Kingdom (“we”, “us”). By creating an account or subscribing, you accept these terms. If you do not agree, please don’t use the service.
2. Who can use Nightly Story
You must be at least 18 years old and the parent or legal guardian of the child the stories are for (or have their permission). The subscription and account are managed by you, the adult — the service is not intended to be used directly by children.
3. What we provide
We aim to write and deliver a brand-new, personalised bedtime story to your inbox each evening, for the child on your account, based on the details you share. Stories are written by AI and checked for safety before sending.
We work hard to deliver every night, and we have safeguards so that if something goes wrong a gentle, vetted story is sent instead. Even so, we can’t guarantee uninterrupted delivery, and an occasional missed or delayed story is not a breach of these terms. “A fresh story every night” describes our promise and effort — exact, literal non-repetition is a goal, not a guarantee.
4. Free trial
New subscriptions start with a 7-day free trial. You won’t be charged during the trial. If you don’t cancel before the trial ends, your paid subscription begins automatically at the price shown when you signed up.
5. Prices, billing and renewals
- Current plans are Standard (£9.99/$9.99 a month, or £99/$99 a year) and Personalised (£14.99/$14.99 a month, or £149/$149 a year), shown in your local currency. Annual plans are billed once a year.
- Payments are taken securely by Stripe. Subscriptions renew automatically each period until cancelled.
- We may change prices from time to time; we’ll give you reasonable notice before any change affects you, and a price change never applies to a period you’ve already paid for.
6. Cancelling and refunds
You can cancel at any time from your preferences page or by emailing us. When you cancel, your subscription continues until the end of the period you’ve already paid for, and then stops. If you cancel during your free trial, you won’t be charged at all. Beyond your statutory rights, paid periods are generally non-refundable — but if something has gone wrong, please get in touch and we’ll do our best to make it right.
7. Your details and acceptable use
You’re responsible for the accuracy of the details you provide and for keeping your account access secure. Please don’t misuse the service — for example, by trying to break or overload it, or by submitting content that is unlawful or that isn’t appropriate for a children’s service. We may suspend or end an account that is misused.
8. Content and intellectual property
The stories we create for your child are yours to read, enjoy, print and keep for your family’s personal, non-commercial use. The Nightly Story name, website, designs and underlying systems remain ours. Please don’t resell or redistribute the stories commercially.
9. Privacy
How we handle your information is set out in our Privacy Policy, which forms part of these terms.
10. Our responsibility to you
We provide the service with reasonable care and skill. To the extent the law allows, we are not liable for indirect or unforeseeable losses, and our total liability connected with the service is limited to the amount you’ve paid us in the 12 months before the issue arose. Nothing in these terms limits liability that cannot legally be limited, and none of this affects your statutory rights as a consumer.
11. Changes and ending the service
We may update these terms or the service from time to time; if a change is significant we’ll let you know. We may also stop offering the service, in which case we’ll give you reasonable notice and won’t charge you for time you don’t receive.
12. Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction — though if you live elsewhere in the UK you may bring proceedings in your own jurisdiction.
